España se adelantó ayer a todos en Bruselas y levantó la mano para dejar claro que el gobierno de José Luis Rodríguez Zapatero se apunta al todos a la cárcel de la Comisaria de Interior Cecilia Malmström. Claro que a nadie le extrañó.

Un proyecto de criminalización de la red todavía indefinido del que poco podemos avanzar salvo las condenas de cárcel que se contemplan y que el objetivo ¿no es otro? que garantizar nuestra seguridad.

También conocemos que la política sueca que impulsa el proyecto tiene justa fama de estar obsesionada por controlar la red al considerarla poco menos que un peligro que promueve el terrorismo, la pornografía infantil y la trata de blancas.

Circulan desde hace días rumores de apariencia tan insólita que pocos han querido prestarles atención. Gran error. Pues era una pista sólida que además ha permitido comprobar y hacer público, hoy lo hace Nación Red, que el fondo de la discrepancia que ha dado pábulo al rumor es de calado y los ciudadanos (lectores) merecen contar con esa información que algunos comparten en mailsmuy privados o mensajes con la garantía BlackBerry.

¿Qué está pasando? Los EE.UU. no quieren que las patentes formen parte del ACTA – en concreto del capítulo 2 – tal y como se puede leer en azul destacado en el texto consolidado (pdf). Europa discrepa y quiere las patentes en ACTA a toda costa. Un sector del gobierno de los EE.UU cree que Obama no debería ceder en “esto”. No es el mundo al revés, aunque lo parezca.

Tras meses de guerra con Redtel y sin rastro de las macrowebs con Cultura, la Coalición propone “cientos” de alianzas con las telecos

La SGAE busca reforzar el canon digital con un subpago sobre cualquier ‘tasa Google’, o acuerdo entre telecos y empresas de internet

Avizoran ya a un solo paso en el Congreso un modelo ‘antipirata’ en el que depositaron el ahora o nunca del nuevo modelo de negocio de los contenidos digitales español. Se vienen arriba, tanto como para tejer una cadena de condiciones para el bautizo de la ‘Ley Sinde’ -que la ministra promete para abril- y rebelar sus expectativas, ésas con las que la SGAE, las sociedades de derechos de autor y buena parte de la industria cultural exigieron a Moncloa el trabajo sucio de perseguir con la LES a 200 webs, a cambio de lanzar al menos dos ‘macrowebs’ de contenidos ‘legales’ financiados en un 90% por Cultura e Industria. Hoy, todos apuntan ya al día después de una regulación que le nacerá condenada a muerte a la ministra. El nuevo caballo de batalla para la SGAE y la Coalición es el de los ingresos y, subidos a él, tocan tambores de tregua con las telecos. La Coalición de Creadores promete -a pesar de los recelos de Redtel al modelo de Sinde- centenares de portales en concurso con las operadoras cuando la LES haga ‘su efecto’. Los creadores buscan sitio en modelos conjuntos de negocio que las telecos sí han desplegado, con un 39% de incremento de ingresos por datos móviles. La SGAE, tras las declaraciones del CEO de Micrososft,  quiere espacio en posibles acuerdos económicos entre los proveedores y buscadores de la red. No sólo necesita compensar -ante el inminente veredicto del TUE- el probable fin del modelo español de canon digital que le ha salvado sus cuentas dos años consecutivos. Ni la sublevación de un millar de municipios, ni el requerimiento del Senado para excluir a las Administraciones del pago del canon, ni la reforma de la LPI permitirán que la SGAE blinde la inercia de sus ingresos.

Hemos podido leer, gracias a nacionred.com, como el gobierno francés ha cumplido su amenaza a la operadora Free, que puso en duda si era o no legal vulnerar la inviolabilidad de las comunicaciones enviando a un tercero datos privados sin orden judicial.

En su momento fueron amenazados con sacar un decreto ley específico para poder multar esta actitud, eso si, sin aclarar los términos en los que la operadora se pronunció.

Pues bien, dicho y hecho, ¿quien dijo que la política era lenta?, en menos de una semana, el gobierno francés ha conseguido ¿consensuar? un decreto ley para "obligar" a los revoltosos a obedecer, sea legal o no lo sea.

Enfado máximo en el Gobierno francés con el operador Free, que a comienzos de esta semana se negó a enviar a sus usuarios sospechosos de haber descargado contendio a través de redes P2P el primer aviso con el fin de amenazarles con cortar su conexión. El ministro de Cultura ya ha anunciado que emprederá acciones legales contra Free por incumplir la Ley Hadopi.

[...] El operador, al contrario que el resto de ellos (SFR, Orange, Bouygues y Numéricable) ha optado por no enviar este primer aviso por email introducido por la Ley Hadopi para perseguir a aquellos internautas que supuestamente infrinjan la propiedad intelectual compartiendo archivos en redes P2P como eMule o BitTorrent. Free argumenta que por ahora estochoca con la protección de los datos personales de los usuarios y asegura que su postura está totalmente de acuerdo con la ley hasta que se firme un acuerdo con el Gobierno que rece lo contrario.

The (D’)Evolution Summit was a civil society meeting to open the minds of the European Community Ministers of Culture, who had gathered in Barcelona for an Informal Meeting in the framework of the Spanish Presidency of the European Union.

The Spanish Minister of Culture Ángeles González Sinde invited the Ministers of Culture of the 27 countries of the European Union (EU) to meet in Barcelona on March 30 and 31, to coincide with the final day of the European Forum for Cultural Industries organized by the Spanish Chamber of Commerce, the Ministry of Culture and the EU Commission of Education of the EU which began on March 29.

Giv€n th€ un€quivocal approach that was promi$€d by th€ m€€ting b€tw€€n Indu$try and “culture”, the creative community and civil society organized three days of activities to explain the culture that we propose for the digital era, a model of culture that benefits everybody, citizens, creators and entrepreneurs: a model of culture that stimulates creativity and not just profits, and, above all, a model that does not attack the Internet or the new possibilities that the Net offers creators and society in general. “Culture” is not just the audiovisual entertainment industry, it is much more: it is our cultural legacy, it is creators and it is every one of us.

We realised that the creative community and civil society may have missed out on an invitation to the Cultural Industries Forum due to the tight schedule of the Ministers. So as citizens, we decided to mitigate this omission by creating a parallel event, the (D’) EVOLUTION SUMMIT: The Returns of Culture.

We, the citizens, invited the Ministers, the speakers and the press to participate in the (D’) Evolution Summit, in order to understand what is really going on with culture and creators.

We timed the event to be compatible with the ministerial schedule, and members of the organisational team were on hand at all times to provide information.

The (D’) Evolution Citizen Summit, the Returns of Culture, explained and offered practical legal solutions to the new issues, based on the international “Charter for Innovation, Creativity and Access to Knowledge”, which is in line with the declaration of the UN Committee of Economic, Social and Cultural Rights [1]

From March 29 to 31, 2010, we organised continuous streaming of all the programmed activities, explaining what was said at the Forum of Cultural Industries and the Informal Meeting of Ministers and responding with answers, proposals and visions from citizens – as if we had been asked for our input.

The program alternated between sections that provided a detailed explanation of what will be required if we are to move towards a model that will be of benefit to everybody and ways to achieve this aim, and other sections that turned to practical examples.
